WebMasterStock.com Royalty Free License Information

Our "royalty-free" licensing is different from other stock sites. "Royalty Free" basically means that you pay once to use a particular image, then do not pay any further "royalties" on that image.

Microstock image licenses are tricky however, and different stock houses allow different things. Nearly none of the major stock houses will allow you to create items for resell with their images. Well, they DO, it's just that the extended license fees for that capability are extremely expensive. There is at least one place that allows creation of website templates to resell at a decent price, but you can't make two templates with the same image. To create a second template - you would need to go purchase the same image a second time.

It becomes nearly impossible to keep up with, and when you are busy - the last thing you want to do is sit and read legal terms to figure out which stock house to get your images from.

Our "royalty-free" license means that you pay for the image once, just like other stock houses. After that, you are allowed to do the following with your purchased image - and yes, you may create digital or physical products for resale:


6.    Grant of License/Use of Content.

License and Permitted Uses.  Subject to the terms and conditions of this Membership Agreement and the Policies, the Company hereby grants to you a limited,  nonexclusive, and nontransferable (except as set forth in this Membership Agreement) license to use the Content purchased by you pursuant to this Membership Agreement for the following purposes (each a “Permitted Use”):

personal use;

advertising purposes, including printed materials, advertisements, product packaging, presentations, film and video presentations, newsletters, commercials, catalogues, trade show signage, and brochures; 

entertainment purposes, including book covers, magazines, newspapers, editorials, set designs and video, broadcast and theatrical presentations;

electronic purposes, including ebooks, software, web page design, web templates, PowerPoint templates and other electronic templates;

scholastic purposes, including classroom presentations, seminars and webcasts;
 
promotional materials, including art prints, posters, paintings, postcards, e-cards, greeting cards, calendars, t-shirts, mugs, hats, and mouse pads; and any other purpose specifically agreed to in writing by the Company.

Editorial Uses.  Notwithstanding Section 6(a) hereof, certain Content on the Website is designated for “editorial use” only.  This Content generally includes, but is not limited to, Content such as news events, sporting events, concerts, street scenes, celebrities, etc.  These images cannot be used for general commercial purposes, but typically can be used only for editorial purposes, such as news reporting, criticism, commentary and parody relating to the Content.  Before utilizing editorial use Content, you should consult an attorney to ensure your use of the Content is in compliance with applicable law.

What you are NOT allowed to use WebMasterStock images for:

Prohibited Uses.  Any use of the Content not specifically listed in Section 6(a) hereof shall be expressly prohibited.  By way of example, and not as a limitation, the following uses of the Content shall be prohibited:
 
use that, in the sole and absolute discretion of the Company, is in any manner obscene, indecent, pornographic, sexually explicit, immoral, profane or otherwise offensive;

use that, in the sole and absolute discretion of the Company, depicts Content in situations involving hate or discrimination based upon race, color, religion, sex, military status, national origin, disability, age, ancestry, sexual preference, or family situations; 

use that, in the sole and absolute discretion of the Company, infringes upon the intellectual property rights of the Company, its licensors, or any third party;

use that, in the sole and absolute discretion of the Company, is libelous, slanderous, or defamatory in any manner, or that would otherwise damage the reputation of others;

use of Content that, in the sole and absolute discretion of the Company, is abusive, harassing, stalking, threatening or otherwise violative of the legal rights of others;

use that, in the sole and absolute discretion of the Company, could be considered the unwanted appropriation or exploitation of a person’s personality, the publication of a person’s private affairs, the wrongful intrusion into a person’s private activities, the depicting of a person in a false light, or any other use that is the invasion of a person’s privacy;

use that, in the sole and absolute discretion of the Company, depicts a person in sensitive subject matter, as judged in the Company’s sole and absolute discretion, including, without limitation mental and physical health issues, social issues, sexual activity or preferences, substance abuse, crime, physical or mental abuse or ailments, or any other offensive subject matter;

use that, in the sole and absolute discretion of the Company, attempts to reverse engineer, duplicate, replicate, decompile, disassemble, reproduce, or copy the source code of the Content, or any portion thereof;

use that, in the sole and absolute discretion of the Company, removes, obliterates, eliminates, hides, minimizes, or modifies, in whole or in part, any notice of copyright, trademark or other proprietary right from any place where it is on or embedded in the Content;
(x)    except as set forth in Section 7 hereof, sub-license, re-sell, rent, lend, assign, gift or otherwise transfer or distribute the Content or the rights granted under this Membership Agreement; or
(xi)    use of Content in image libraries or other online galleries;
(xii)    use that contains viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer or personal property;
(xiii)    use that incorporates any Content into a trademark, service mark, logo, or trade dress; or
(xiv)    use that violates any applicable laws or regulations.
(d)    Other Rights Retained.  All other rights in and to the Content, including, without limitation, all copyright and other intellectual property rights relating to the Content, are retained by the Company or the licensor of the Content, as the case may be.

We have done our best to make sure you are getting the best possible licensing we can give you for stock images. Obviously our prohibited uses are written to include things that are illegal, immoral etc. Of course we don't want you giving our images away, nor do we wish to see one of our images turned into porn for example. Just use common sense, know your rights, and be confident that we are here to help you out as an image buyer!

This spot is reserved for particular images that may need to have stronger rights than most of our images on WebMasterStock.com.

We probably won't be using extended licenses for now - but may need to at some point in the future.

Public Domain

WebMasterStock.com Public Domain License Information

An image marked public domain on WebMasterStock.com means that the image is free of any copyrights. Public domain images have been collected, checked, and many times altered to clean up imperfections within the image before being placed on our site. We do clean up work, color correction and more to our own images, as well as any scans, or public domain materials. We also lend some of our own images to the public domain, right here on our site.

You can find many lovely free images on the internet, but sometimes it is difficult to be sure they are legal for you to use. Images that we have marked as public domain here on WebMasterStock.com - have been collected from appropriate public domain sources, or added to the public domain from our own collections. We retain original documentation for all public domain images.
